These Terms of Service ("Terms") govern your use of Prove It Marketing's services. By signing up for or using our services, you agree to be bound by these Terms.

1. Service Description

Prove It Marketing provides lead generation systems for local businesses, including:

  • Custom-built, conversion-optimized landing pages and funnels
  • Automated follow-up systems (text, email, and reminders)
  • Local SEO optimization
  • Monthly performance optimizations

2. 7-Day Free Trial Terms

IMPORTANT: Please read these trial terms carefully

Eligibility

  • The 7-day free trial is available ONLY to new clients
  • Each business/individual is eligible for ONE trial period only
  • If you cancel and later decide to sign up again, you are NOT eligible for another trial period
  • Returning clients must pay the full monthly service price immediately upon signup

Trial Limitations

  • We do NOT guarantee implementation of all systems within the 7-day trial period
  • We do NOT guarantee any leads, booked appointments, phone calls, or sales during the trial
  • The trial does NOT include ad account management for any third-party platforms (Meta, Google, etc.)
  • Results may vary and depend on multiple factors outside our control

Cancellation Policy

  • You may cancel at any time during the 7-day trial period
  • If you cancel within the trial period, we will immediately stop all work on your account
  • No support will be provided after cancellation unless you pay the monthly service price in full
  • To continue receiving service after cancellation, you must pay $297/month (or current pricing)

Digital Asset Ownership

  • All digital assets created during the trial (excluding automations) become property of the business/user
  • Automation sequences, workflows, and system configurations remain property of Prove It Marketing
  • You may export or recreate content, but not our proprietary automation systems

3. Pricing and Payment Terms

Monthly Subscription

  • After the 7-day trial, the service costs $297 per month
  • Payment is due monthly in advance
  • All payments are non-refundable

Price Changes

PRICES ARE SUBJECT TO CHANGE AT ANY TIME WITHOUT WRITTEN NOTICE

If you cancel and later re-subscribe, you will be subject to the pricing in effect at the time of re-subscription, which may be higher than your previous rate.

4. No Guarantees Disclaimer

IMPORTANT DISCLAIMER:

We make NO GUARANTEES regarding individual results. All results mentioned in our advertisements, landing pages, or marketing materials are from past clients and do not guarantee your individual results.

We specifically do NOT guarantee:

  • Any specific number of leads or inquiries
  • Any appointments or phone calls
  • Any sales or revenue increases
  • Any return on investment (ROI)
  • Success of your business or marketing efforts

Success depends on numerous factors including but not limited to: your market, competition, business model, pricing, service quality, ad spend, and overall business operations.

5. User Obligations

By using our services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws and regulations
  • Not use our services for any illegal or unauthorized purpose
  • Respond to our requests for information in a timely manner
  • Pay all fees when due

6. Intellectual Property

  • All content, features, and functionality of our services are owned by Prove It Marketing
  • You retain ownership of your business information and content you provide
  • We retain ownership of all systems, processes, and methodologies
  • You may not copy, modify, or reverse engineer our proprietary systems

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the amount paid by you in the preceding month
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not liable for any loss of profits, revenue, data, or business opportunities
  • We are not responsible for third-party services or platforms

8. Indemnification

You agree to indemnify and hold harmless Prove It Marketing, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your business operations or marketing activities

9. Termination

  • Either party may terminate the service at any time
  • We may terminate immediately for violation of these Terms
  • Upon termination, your access to our systems will be disabled
  • Termination does not relieve you of payment obligations incurred

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.
